The Federal Fair Labor Standards Act and overtime
The Fair Labor Standards Act (FLSA) governs employers engaged in interstate commerce or with greater than $500,000 in business each year. Nonexempt employees are entitled to receive overtime pay for any hours worked beyond 40 in one workweek. An employee’s overtime pay rate is one and one half times their regular rate of pay.
Exempt employees are not entitled to overtime pay. To be considered exempt, an employee must receive at least $455 per week on a salary basis and perform specified job functions. Exempt employees and their job duties must fall into one of the following categories:
