Exempt and nonexempt employees under FLSA overtime rules

The federal Fair Labor Standards Act (FLSA) classifies employees as exempt or nonexempt for the purposes of receiving an overtime premium for hours worked above 40 in a given week. Classification is generally based on the following three criteria:

  • How employees are paid
  • How much employees are paid
  • The type of work performed

Exempt employees are salaried and receive a guaranteed amount of pay each week. Nonexempt employees are paid hourly and are entitled to receive minimum wage and time-and-a-half for overtime. Sometimes employees who are actually nonexempt and should receive overtime pay are misclassified as exempt. K.P. Minimum wage disputes

The current U.S. federal minimum wage is $7.25 per hour. With a few exceptions, Georgia employees must be paid at this rate or higher. Meals and rest violations

Neither the FLSA nor Georgia law requires employers to offer lunch or coffee breaks. However, many employers do offer these chances for employees to step away from their job duties for a short time. The law does require that employees be paid for short breaks—generally those that last fewer than 30 minutes–and this time must be included in work hour and overtime calculations.
