Pregnancy Discrimination in Atlanta
Expecting the birth of a child should be one of the happiest times of your life. Unfortunately, sometimes employers do not react to your news as favorable and may discriminate against you. Atlanta pregnancy discrimination law firm The Reddy Law Firm, P.C. discusses the rights of pregnant employees and the law that protects them. These include the right to work as long as their pregnancy permits.
Atlanta pregnancy law
When Title VII of the Civil Rights Act of 1964 was created, it had a profound effect on discrimination for a variety of people including pregnant women. This law affects those who have 15 or more employees and also includes state and local governments. It has protections that include:
- Hiring—An employer cannot refuse hiring someone who is pregnant because of her condition, or if other people like customers or co-workers have prejudice against pregnant workers.
- Pregnancy and maternity leave—Pregnant women can work as long as they are able to perform their tasks. Also, employers must hold open a job for a pregnancy-related absence for the same amount of time that jobs are held open for employees on disability leave.
- Health Insurance—As the same basis with other medical conditions, health insurance that has been provided by an employer must cover expenses for pregnancy-related conditions.
- Fringe Benefits—Includes that the same benefits that are provided to workers on leave should be given to those with pregnancy-related conditions. This includes benefits such as temporary disability benefits, accrual and crediting of seniority, pay increases, and vacation calculation. In the case of abortion, an employer doesn’t need to provide health insurance for expenses from abortion except in the case where the mother’s life was endangered.
